At-Berth Regulation forms now available


Fleets are required to submit documentation by March 21 in order to qualify for temporary relief.



The California Air Resources Board (ARB) has posted notification and reporting forms for the December 2013 regulatory advisory.

As specified in the December 2013 regulatory advisory, fleets are required to submit documentation to the ARB to qualify for temporary relief under each scenario they intend to use.

Fleets also need to provide evidence that they have made a 'good faith effort' to comply with the At-Berth Regulation.

These forms are available in the 'Forms and Tools' section of the ARB shore power website. Links to these pages have been provided below.

Fleets are required to complete the 'December 2013 Regulatory Advisory Notification Form' and return it by March 21, 2014. In addition, they are required to provide verification of their claims. To do this, fleets must complete the separate 'December 2013 Regulatory Advisory Reporting Form'.

The notification form, and supporting information, must be sent to the ARB by March 21, 2014. Documentation can be sent via email to shorepower@arb.ca.gov or by post to the following address:

Failure to Comply

Regarding the issue of failure to comply, the ARB says: "Fleets that fail to fully comply or to demonstrate good faith efforts pursuant to this Advisory may be subject to enforcement action and penalties. Fleets that make good faith efforts as described in this Advisory, but are not in compliance with the At-Berth Regulation requirements by the dates outlined above, may be subject to enforcement action and penalties."
