BIMCO has adopted new contractual clauses addressing obligations under the EU FuelEU Maritime Regulation and Emissions Trading Schemes (ETS) in sale and purchase transactions, while advancing work on contracts covering biofuels, liquefied CO₂ carriage, and electric vehicle transportation.
The Baltic and International Maritime Council's Documentary Committee approved the FuelEU Maritime Clause and ETS Clause for Memoranda of Agreement in 2025. According to BIMCO, these clauses address obligations under the EU FuelEU Maritime Regulation and Emissions Trading Schemes in sale and purchase transactions, with the aim of ensuring transparency and alignment with regulatory requirements.
The committee also adopted SUPERMAN, a revised standard agreement for supervision services during vessel construction. The updates reflect recent changes in BIMCO's SHIPMAN and CREWMAN contracts and incorporate industry practices.
Work continues on developing an ETS clause for BARECON bareboat charters, which is intended to clarify compliance responsibilities and provide flexibility for owners and charterers. The committee is also reviewing progress on revisions to SALEFORM, which includes updates to delivery provisions, sanctions compliance, and integration of new regulatory clauses.
The Documentary Committee is progressing with drafting a biofuel clause for time charter parties to address the use of biofuels under time charter arrangements. The organisation says this supports decarbonisation efforts.
BIMCO is developing CO2TIME, a new contract for the carriage of liquefied CO₂, designed to reflect operational realities and regulatory requirements in the emerging sector.
A subcommittee is working on WINDSEACON, described as a hybrid contract combining transport and installation of wind turbine generators. Work is also underway on WRECKHIRE, with the subcommittee refining clauses and developing a standard letter of security for marine salvage contracts.
The committee is revising HEAVYLIFTVOY to modernise loading and discharge provisions and update the bill of lading for heavy lift shipping. RECYCLECON, the contract for ship recycling, is being revised to reflect the entry into force of the Hong Kong Convention and address reputational risks and current market practices.
A subcommittee has begun drafting standard clauses for the transportation of electric vehicles onboard roll-on/roll-off vessels and car carriers. Drafting of clauses for containerised transportation and stationary batteries, including Battery Energy Storage Systems, will follow.
The meeting included an update on BIMCO's regional workshops, which recently addressed sanctions compliance, cybersecurity, and energy efficiency measures. Members discussed expedited procedures for urgent industry needs and participated in a survey on the role of artificial intelligence in contractual work.
