North P&I launches guide on avoiding and defending bunker disputes

Offers advice on how to prevent marine fuel disputes and how best to succeed when pursuing or defending a claim.

North of England P&I Club (North P&I) has published a new loss prevention guide on marine fuels.

The document, entitled 'Marine Fuels: Preventing Claims and Disputes', offers advice on how to avoid marine fuel claims and disputes, and how best to succeed when pursuing or defending a claim. It builds on an earlier publication, 'Bunker Claims Prevention: A Guide to Good Practice', written by North P&I's Richard Bracken and Mike Salthouse in conjunction with fuel expert Chris Fisher.

The guide is designed to help seagoing officers, vessel operators, vessel managers and time charterers understand what can go wrong when purchasing, bunkering and using marine fuels, and what steps can be taken to prevent them and mitigate their impact.

It covers marine fuels from production and refining all the way to burning in the ship's engines. The characteristics of marine fuels are also discussed along with purchasing, contractual obligations, loading, handling, sampling and testing.

Claims management

When addressing claims management and the collection of evidence, the guide reinforces North P&I's 'golden rule' on resolving bunker quality and quantity disputes: "The success of any bunker quality or quantity dispute will depend upon the quality of evidence collected in support of the claim."

In other words, the party with the strongest evidence to support their claim is more likely to succeed.

At the same time, another of the guide's mantras is 'prevention is better than cure', as it will hopefully help to avoid or minimize claims altogether.
