OMB bunker case to go before Court of Appeal

Ferry operator to pursue its claim for compensation against German bunker supplier.



Passenger and freight transportation company Finnlines says it has decided to appeal a judgment by a district court in Germany concerning the price it paid for marine fuel supplied by German bunker firm OMB Ostsee Mineralol-Bunker GmbH (OMB).

The ferry operator recently took OMB to court, demanding compensation for "the damage that has occurred to the company" due to an alleged price differential between the price it paid for the bunker fuel supplied and the actual market price.

Commenting on the reason for its EUR 2.76 million claim against Rostock-based OMB, Finnlines said in documentation released this week: "The company's basis for the demand is that OMB has abused its dominant position in the relevant market and the company was forced to buy fuel from OMB, OMB being the sole supplier."

The district court of Rostock dismissed Finnlines' claims in full. The Finnish firm says it has decided to pursue the matter and that the case will now be brought before the Court of Appeal.
